Fundamental Rights, Directive Principles & Fundamental Duties


🔹 CONSTITUTIONAL TRIAD: RIGHTS–DUTIES–DIRECTIVES

The Indian Constitution balances individual liberty, social justice, and collective responsibility through a unique constitutional triad:

  • Fundamental Rights (Part III)
  • Directive Principles of State Policy (Part IV)
  • Fundamental Duties (Part IVA)

GS-II answers must reflect this balance rather than treating these parts in isolation.


⚖️ FUNDAMENTAL RIGHTS (PART III)

Fundamental Rights protect individuals from arbitrary state action and ensure democratic freedoms.

Major Categories

  • Right to Equality (Articles 14–18)
  • Right to Freedoms (Article 19)
  • Right against Exploitation (Articles 23–24)
  • Right to Freedom of Religion (Articles 25–28)
  • Cultural & Educational Rights (Articles 29–30)
  • Right to Constitutional Remedies (Article 32)

These rights are justiciable and enforceable by courts.


📌 REASONABLE RESTRICTIONS & LIMITATIONS

Fundamental Rights are not absolute. They are subject to reasonable restrictions in the interest of:

  • Public order
  • Morality and decency
  • Sovereignty and integrity of India
  • Security of the State

UPSC often asks about the balance between rights and national interests.


🏛️ DIRECTIVE PRINCIPLES OF STATE POLICY (PART IV)

DPSPs provide socio-economic direction to the State and aim to establish a welfare state.

Key Themes:

  • Social and economic justice
  • Equitable distribution of resources
  • Promotion of education and health
  • Environmental protection

Though non-justiciable, they are fundamental in governance.


⚖️ RELATIONSHIP BETWEEN RIGHTS & DPSPs

Initially seen as conflicting, Fundamental Rights and DPSPs are now viewed as complementary.

Judicial interpretation has evolved to harmonise both parts in favour of social justice.

This evolution reflects constitutional pragmatism.


🧭 FUNDAMENTAL DUTIES (PART IVA)

Fundamental Duties remind citizens that rights come with responsibilities.

Core Duties include:

  • Respect the Constitution and national symbols
  • Promote harmony and unity
  • Protect environment and public property
  • Develop scientific temper and humanism

Though non-enforceable, they guide ethical citizenship and governance.


🧠 CONTEMPORARY RELEVANCE (GS-II + GS-IV)

  • Freedom of speech vs hate speech
  • Right to privacy in digital age
  • Environmental duties and climate action
  • Welfare policies and DPSPs

Strong answers link constitutional provisions with present-day governance challenges.
