Special Question–Answer Notes (Part 1)
📜 THE PREAMBLE – SOUL OF THE CONSTITUTION
Relevant Articles: Preamble
UPSC Mains Question:
“The Preamble embodies the philosophy of the Indian Constitution.”
Discuss. (150 words)
Model Answer:
The Preamble serves as the guiding philosophy of the Indian Constitution. It declares India to be a Sovereign, Socialist, Secular, Democratic Republic and outlines the objectives of Justice, Liberty, Equality, and Fraternity.
It reflects the ideals on which the Constitution is based and provides direction to the interpretation of constitutional provisions. The Supreme Court has held that the Preamble is part of the Constitution and forms a key element of the Basic Structure.
Thus, the Preamble is not merely an introduction but a moral compass that guides governance and constitutional interpretation.

FUNDAMENTAL RIGHTS (Articles 12–35)
UPSC Mains Question:
“Fundamental Rights are not absolute but essential for a democratic society.”
Examine. (150 words)
Model Answer:
Fundamental Rights guarantee individual liberty and protect citizens from arbitrary state action. These rights ensure equality before law, freedom of expression, and protection of life and personal liberty.
However, they are not absolute and are subject to reasonable restrictions in the interests of sovereignty, public order, morality, and security. This balance ensures that individual freedoms do not undermine social order.
Judicial interpretation has strengthened Fundamental Rights while upholding constitutional limits, making them essential pillars of Indian democracy.
Keywords: Reasonable restrictions, judicial review
RIGHT TO EQUALITY (Articles 14–18)
UPSC Mains Question:
Article 14 strikes a balance between equality and arbitrariness. Discuss.
Model Answer:
Article 14 guarantees equality before law and equal protection of laws. It does not imply uniform treatment but allows reasonable classification based on intelligible differentia.
The judiciary has interpreted Article 14 as a safeguard against arbitrariness in state action, thereby expanding its scope beyond formal equality.
Thus, Article 14 promotes substantive equality while allowing flexibility for social justice and affirmative action.
🧭 DIRECTIVE PRINCIPLES OF STATE POLICY (Articles 36–51)
UPSC Mains Question:
“Directive Principles are fundamental in governance despite being non-justiciable.”
Discuss. (150 words)
Model Answer:
Directive Principles provide socio-economic goals for the State to achieve a welfare society. Though non-justiciable, they guide policy formulation and legislative action.
Over time, courts have harmonised Fundamental Rights and DPSPs, recognising their complementary nature in achieving constitutional goals.
Hence, DPSPs play a crucial role in shaping inclusive and just governance.

Model Answer:
