🚨 EMERGENCY PROVISIONS – CONSTITUTIONAL CONTEXT
Emergency provisions enable the State to deal with extraordinary situations such as war, external aggression, armed rebellion, constitutional breakdown, or financial instability.
While they strengthen national unity and security, they also pose serious challenges to federalism, democracy, and civil liberties.

Emergency provisions are designed to protect the Constitution and ensure continuity of governance during extraordinary situations. They allow temporary centralisation of power to address threats to national security or constitutional order.
However, historical experience shows that misuse of emergency powers can undermine democracy, federalism, and fundamental rights. Suspension of civil liberties and erosion of state autonomy have raised serious constitutional concerns.
Judicial interpretation, parliamentary approval, and constitutional amendments have introduced safeguards against arbitrary use. The emphasis today is on restraint and accountability.
Thus, emergency provisions must remain exceptional, time-bound, and constitutionally controlled to preserve democratic governance.
NATIONAL EMERGENCY (ARTICLE 352)
