Federalism, Centre–State Relations & Emergency Provisions (Part 3)
🏛️ FEDERALISM IN INDIA
Relevant Articles: Articles 245–255, Seventh Schedule
UPSC Mains Question:
“Indian federalism is often described as ‘quasi-federal’ in nature.”
Critically examine. (250 words)
Model Answer:
Federalism in India is characterised by a division of powers between the Centre and the States, as provided in the Seventh Schedule of the Constitution. While this arrangement resembles a federal structure, certain features impart a unitary bias.
The Constitution grants greater powers to the Centre in matters such as residuary subjects, emergency provisions, and the appointment of Governors. The Centre also plays a significant role in financial devolution and inter-state coordination.
At the same time, states enjoy autonomy in subjects listed under the State List, and the Supreme Court has recognised federalism as part of the Basic Structure. Recent emphasis on cooperative and competitive federalism has strengthened state participation in governance.
Thus, Indian federalism is flexible, enabling unity while accommodating regional diversity, making it a pragmatic rather than rigid federal system.
CENTRE–STATE RELATIONS
UPSC Mains Question:
Discuss the constitutional and institutional mechanisms for managing
Centre–State relations in India. (250 words)
Model Answer:
Centre–State relations in India are governed by constitutional provisions covering legislative, administrative, and financial dimensions. Legislative relations are defined through the Union, State, and Concurrent Lists, while administrative relations ensure cooperation in policy implementation.
Financial relations are managed through constitutional bodies such as the Finance Commission, which ensures equitable distribution of resources. Institutional mechanisms like the Inter-State Council promote dialogue and coordination between the Centre and States.
However, challenges such as fiscal stress, use of central agencies, and political differences often strain federal relations. Strengthening cooperative federalism and respecting constitutional boundaries are essential for harmonious Centre–State relations.
Thus, effective federal governance requires collaboration, trust, and constitutional spirit.
🏦 FINANCIAL FEDERALISM
UPSC Mains Question:
How does financial federalism impact the autonomy of states in India?
Analyse. (150 words)
Model Answer:
Financial federalism determines the fiscal autonomy of states by regulating revenue-sharing and expenditure responsibilities. While states have constitutionally assigned functions, their revenue-raising capacity remains limited.
Dependence on central transfers through Finance Commission recommendations and grants affects state autonomy. Although recent reforms aim to increase tax devolution, states continue to face constraints in meeting developmental needs.
Strengthening fiscal decentralisation and enhancing states’ revenue capacity are crucial for effective federalism.
🚨 EMERGENCY PROVISIONS (Articles 352–360)
UPSC Mains Question:
Emergency provisions are intended to safeguard the Constitution,
yet they have the potential to undermine federalism. Discuss. (250 words)
Model Answer:
Emergency provisions empower the Centre to respond to extraordinary situations such as war, external aggression, or constitutional breakdown. They ensure continuity of governance and national integrity during crises.
However, the use of emergency powers centralises authority, suspending normal federal arrangements. Historical misuse of these provisions has raised concerns regarding erosion of democratic values and state autonomy.
Judicial safeguards, parliamentary approval, and constitutional amendments have strengthened checks on emergency powers. Thus, while emergencies are necessary for national security, their use must remain exceptional and constitutionally restrained.
PRESIDENT’S RULE (Article 356)
UPSC Mains Question:
Critically examine the role of Article 356 in Indian federalism. (150 words)
Model Answer:
Article 356 allows the imposition of President’s Rule in case of failure of constitutional machinery in states. While intended as a safeguard, its misuse has historically undermined state autonomy.
Judicial intervention has laid down strict guidelines to prevent arbitrary use of this provision. Today, Article 356 is subject to greater scrutiny, reinforcing federal balance.
