UPSC MAINS • GS-II & GS-IV
Ethics, Constitutional Morality & Public Life (Part 18)

ETHICS IN PUBLIC LIFE – CONSTITUTIONAL FOUNDATION

Ethics in public life refers to moral principles that guide conduct of public officials in the exercise of authority. In a constitutional democracy, ethics is inseparable from governance.

The Indian Constitution embeds ethical values through the Preamble, Fundamental Rights, Directive Principles, and Fundamental Duties, creating a moral framework for public life.

CONSTITUTIONAL MORALITY – MEANING & SIGNIFICANCE

Constitutional morality implies adherence to the core principles of the Constitution beyond mere literal interpretation. It demands respect for values such as liberty, equality, dignity, pluralism, and rule of law.

It acts as a guiding principle for institutions and individuals while exercising constitutional authority.

 UPSC MAINS QUESTION

“Constitutional morality is essential for sustaining a democratic polity.” Discuss with reference to Indian governance. (250 words)

Model Answer:

Constitutional morality ensures that governance is guided not only by the letter of the law but also by its spirit. It requires public authorities to uphold constitutional values even in the face of political or social pressure.

In India, constitutional morality has guided judicial interpretation to protect individual rights, strengthen institutional independence, and promote inclusiveness. It serves as a check against majoritarianism and arbitrary exercise of power.

In the absence of constitutional morality, formal democratic structures may exist without substantive justice. Therefore, nurturing constitutional morality among institutions and citizens is vital for democratic stability.

ETHICS VS LAW IN PUBLIC ADMINISTRATION

UPSC Mains Question:
“Legality does not always guarantee ethical governance.” Examine this statement in the context of public administration. (150 words)

Model Answer:

Law prescribes minimum standards of conduct, while ethics represents higher moral obligations. An action may be legally valid yet ethically questionable.

Public officials are expected to go beyond legal compliance and act in public interest, with integrity and impartiality. Ethical governance strengthens public trust and democratic legitimacy.

ROLE OF INSTITUTIONS IN ETHICAL GOVERNANCE

Institutions such as Parliament, Judiciary, constitutional bodies, and civil services play a crucial role in upholding ethical standards.

Institutional accountability, transparency, and independence are essential for ethical governance.

 ETHICAL CHALLENGES IN PUBLIC LIFE

  • Conflict of interest
  • Corruption and misuse of power
  • Political interference
  • Lack of accountability

These challenges weaken public confidence and undermine constitutional governance.

 PROMOTING ETHICAL GOVERNANCE

Ethical governance can be strengthened through codes of conduct, ethics training, transparent decision-making, and strong institutional checks.

Leadership by example and citizen awareness are equally important.

 MAINS VALUE ADDITION
